Privacy Policy

Last updated: July 2026

This Privacy Policy describes how Five Boroughs Finance LLC, doing business as Five Boroughs Capital ("Five Boroughs Capital," "we," "us," or "our"), a commercial financing brokerage, collects, uses, shares, and protects information when you visit our website, submit an application, or otherwise interact with us. It is intended for U.S. business owners and authorized representatives.

About Our Business

Five Boroughs Capital is a commercial financing brokerage. We help business owners request commercial financing — including merchant cash advances, working capital, business lines of credit, equipment financing, term financing, and SBA-related options — and we work with third-party funding providers who evaluate and, in their sole discretion, approve or decline requests. We are not a bank.

Information We Collect

Depending on how you interact with us, we may collect:

  • Business contact information (business name, DBA, address, phone, email).
  • Owner and authorized representative contact information (name, title, email, phone).
  • Business ownership, formation, and identification information (entity type, state of formation, EIN, ownership percentages, and, where required by a funding provider, government-issued identification).
  • Application information (time in business, industry, funding amount requested, use of funds).
  • Business financial documents (typically the last several months of business bank statements) and other underwriting documents a funding provider may request.
  • Communications you send us (emails, call notes, SMS messages, form submissions).
  • Website usage data (IP address, browser type, device information, referring URLs, pages viewed, general location derived from IP, and cookie identifiers).

We do not intentionally collect information from children under 16, and our services are directed to businesses and their authorized representatives.

How We Use Information

  • To evaluate commercial financing requests and route applications to appropriate funding providers.
  • To communicate about your application, present available options, and support you during and after funding.
  • To operate, secure, maintain, and improve our website and services.
  • To prevent fraud and misuse and to verify the identity and authority of applicants.
  • To comply with applicable laws and to enforce our Terms of Use and other agreements.

How We Share Information

We may share the information described above with:

  • Funding providers, lenders, funders, and underwriting partners who evaluate financing requests and may present offers.
  • Service providers that help us operate the business (for example, hosting, email, phone/SMS delivery, document handling, analytics, and security providers), each bound by contractual obligations regarding use of information.
  • Payment processors and related business financing partners that are necessary to originate or service financing you accept.
  • Legal, regulatory, and safety recipients where we believe in good faith that sharing is necessary to comply with law, respond to lawful process, protect our rights, or protect the safety of people or property.
  • Successors in the event of a business transaction such as a merger, acquisition, financing, or sale of assets.

We do not sell your personal information for unrelated consumer marketing. Any sharing with third parties is for the purpose of evaluating, offering, or servicing commercial financing, or otherwise operating our business as described above.

Email, Telephone, and SMS Communications

When you submit a form, call us, or otherwise provide your contact information, you agree that we and our authorized representatives may contact you by phone (including autodialed or prerecorded calls), email, and SMS text message at the numbers and addresses you provide, for purposes related to your financing request and your relationship with us.

Message frequency may vary. Message and data rates may apply. You can reply STOP at any time to opt out of SMS messages from a given campaign, or reply HELP for help. Opting out of SMS does not opt you out of other communications you have requested (for example, email or phone). Consent to receive marketing SMS is not a condition of any purchase, application, or financing decision.

Cookies, Analytics, and Similar Technologies

We use cookies and similar technologies to operate the site, remember preferences, measure performance, and, with your consent where required, understand how visitors use the site and the effectiveness of our outreach. You can manage your choices using our on-site cookie preferences tool and through your browser settings. Blocking or deleting cookies may affect how the site functions.

Where legally required, we will not load non-essential analytics or advertising cookies before you provide consent.

Data Retention

We retain information for as long as needed to provide our services, respond to inquiries, meet our legal, tax, accounting, and recordkeeping obligations, resolve disputes, and enforce our agreements. Retention periods vary based on the type of information and the purpose for which it was collected. When information is no longer needed, we take reasonable steps to delete, de-identify, or securely archive it.

Data Security

We use administrative, technical, and physical safeguards intended to protect information against loss, misuse, and unauthorized access, disclosure, alteration, or destruction. No method of transmission over the internet or method of electronic storage is completely secure, and we cannot guarantee absolute security.

Your Privacy Choices and Requests

You may request to access, correct, update, or delete personal information we hold about you, ask us to restrict certain processing, or opt out of certain communications. To make a request, email us at submissions@fiveboroughscapital.com. We may need to verify your identity or authority to submit a request on behalf of a business before we can act.

State Privacy Rights

Residents of certain U.S. states (including, where applicable, California, Colorado, Connecticut, Virginia, Utah, and others) may have additional rights regarding personal information, such as the right to know, access, correct, delete, or opt out of certain processing or sales/sharing as those terms are defined under state law. We do not sell personal information for unrelated consumer marketing. To exercise a state privacy right, contact us using the details below. You may designate an authorized agent to act on your behalf; we may take reasonable steps to verify the agent and the underlying request.

Third-Party Sites and Services

Our site may link to third-party websites or services (including funding providers). We are not responsible for the privacy practices of those third parties. Please review their privacy policies separately.

Changes to This Policy

We may update this Privacy Policy from time to time. When we do, we will update the "Last updated" date above. Material changes may be communicated by additional notice where appropriate.
